Terms of Service

By creating an account, accessing, or using the Services, you represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent.

Towcore provides software for tow operators to manage dispatching, online bookings, customer records, communications, and payments. We may update, add, or remove features over time. The Services are provided as software; Towcore does not provide towing or roadside services and is not a party to transactions between operators and their customers.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Accounts may include roles such as owner/admin, dispatcher, and driver, each with different permissions. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use.

You agree not to:

• Use the Services in violation of any law or regulation.
• Infringe the rights of others or send unlawful, harassing, or misleading communications.
• Attempt to gain unauthorized access to the Services or disrupt their operation or security.
• Reverse engineer, resell, or misuse the Services except as expressly permitted.
• Use messaging features except in compliance with applicable regulations (including 10DLC and consent requirements).

Operators are responsible for the accuracy of the data they enter, for obtaining any consents required to contact their customers, and for their own compliance with laws applicable to their business. You are responsible for the content you submit and for how you use information obtained through the Services.

Subscription fees, if any, are described at signup or in your order. Payment processing for jobs is handled by our third-party provider (Stripe) and is subject to its terms. You authorize us and our provider to charge applicable fees. Except as required by law or expressly stated, fees are non-refundable. Card processing fees charged by the payment provider are your responsibility.

The Services integrate with third-party providers (such as Stripe, Twilio, and mapping providers). Your use of those integrations may be subject to the third parties’ terms, and we are not responsible for their acts or omissions.

The Services, including all software, content, and trademarks, are owned by Towcore or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. You retain ownership of the data you submit.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWCORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Towcore and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ceases; provisions that by their nature should survive will survive.

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Services.
